Terms of Use

1. General Provisions and Definitions

These Terms of Use (hereinafter "Terms") govern access to the website symbiose.club (hereinafter "the Website") and the use of services offered by Symbiose, a sole proprietorship registered in the United Arab Emirates (hereinafter "Symbiose", "we", "us").

These Terms are governed primarily by UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions. For users residing in France, the mandatory provisions of the French Code de la Consommation apply in addition.

Definitions:

• "User" / "Customer": any adult natural person accessing the Website and/or ordering a service.
• "Service": the personalized numerology theme (PDF report) and/or the digital consultation offered on the Website.
• "Order": the process by which a Customer orders a Service through the online order form.
• "Digital Content": the personalized numerology PDF report delivered electronically.

By accessing the Website or placing an order, the User unconditionally accepts these Terms in their entirety. If the User does not agree to these Terms, they should refrain from using the Website or its services.

2. Acceptance of Terms

Use of the Website constitutes full and unconditional acceptance of these Terms. Symbiose reserves the right to modify these Terms at any time. Modifications take effect upon publication on the Website. Continued use of the Website after publication of modifications constitutes acceptance of the new Terms.

During the order process, the Customer is asked to check a box confirming that they have read and accepted these Terms. This acceptance is a prerequisite for completing any order.

3. Description of Services

Symbiose offers the following services:

• Personalized Numerology Theme (PDF): an in-depth numerological analysis prepared from personal data provided by the Customer (first name, birth name, date of birth), delivered as a PDF document by email within 72 business hours following payment confirmation.
• Digital Consultation: a personal development coaching session based on numerology, the details of which are specified at the time of booking.

Services are provided in French and/or English depending on the language chosen by the Customer at the time of ordering.

4. Disclaimer — Numerology Is Not Medical Advice

The services offered by Symbiose are exclusively within the realm of personal development and symbolic and numerological exploration. They do not constitute:

• medical, psychological, psychiatric, or therapeutic advice;
• legal, financial, or professional consultations;
• prophecies or predictions of future events.

Symbiose shall not be held liable for decisions made by the Customer on the basis of the numerological analyses provided. In the event of medical, psychological, or other difficulties, the Customer is encouraged to consult a qualified and authorized professional.

5. Order Process

Ordering a Service is completed in several steps via the online form:

1. Entry of personal information required to prepare the theme (first name, birth name, date of birth, gender).
2. Entry of delivery email address and contact information.
3. Order summary and acceptance of these Terms.
4. Secure payment via Stripe (redirection to Stripe-hosted payment page).
5. Order confirmation by email and commencement of theme preparation.

All orders are firm and final upon payment validation. Symbiose reserves the right to refuse or cancel any order in the event of payment issues, incorrect or fraudulent information, or exceptional circumstances.

6. Pricing

Service prices are displayed in euros (EUR) on the Website at the time of ordering. They are inclusive of all applicable taxes.

Symbiose operates as a micro-entrepreneur (auto-entrepreneur) not subject to VAT under Article 293 B of the French General Tax Code (TVA franchise en base). Consequently, no VAT is applied to displayed prices.

Symbiose reserves the right to modify its prices at any time. The applicable prices are those in force at the time the order is confirmed.

7. Payment

Payment is made online, securely, via Stripe (Stripe, Inc.), a payment service provider certified at PCI DSS Level 1. The Customer is redirected to Stripe's hosted payment page to complete their transaction.

Accepted payment methods are those offered by Stripe on the payment page (Visa, Mastercard, American Express bank cards and other methods available by region).

Banking data (card number, CVV, expiry date) are entered directly on Stripe's secure page and never transit through Symbiose's servers. Symbiose stores no banking data.

In the event of a payment failure, the order is not validated and the Customer is invited to try again.

8. Delivery

The personalized numerology theme is delivered exclusively as a PDF file by email, to the email address provided by the Customer at the time of ordering.

The delivery timeframe is 72 business hours from payment confirmation. Symbiose undertakes to meet this deadline to the best of its ability. In the event of a delay, the Customer will be notified by email.

If the Customer does not receive their PDF within the stated timeframe, they are invited to contact Symbiose at contact@symbiose.club with their order number.

9. Right of Withdrawal

9.1 Applicable Right of Withdrawal (General)

Under UAE Federal Law No. 15 of 2020 on Consumer Protection, the Customer has a period of 7 (seven) days from the date of purchase to exercise their right of withdrawal, without being required to give reasons or pay any penalties.

To exercise this right, the Customer must send a clear written notification to Symbiose at contact@symbiose.club before the 7-day period expires.

9.2 Exception for Digital Content — UAE Law

The right of withdrawal ceases to apply once performance of the service or supply of digital content has commenced with the Customer's express consent and with the Customer's acknowledgment that they would lose their right of withdrawal once performance had begun.

By placing an order and proceeding with payment, the Customer expressly acknowledges that Symbiose may begin preparing the numerology theme immediately upon payment confirmation, and agrees that the right of withdrawal may no longer be exercised once preparation of the PDF has commenced.

9.3 Exception for French Residents — Art. L221-28 French Consumer Code

For Customers residing in France, under Article L221-28 13° of the French Code de la Consommation, the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a physical medium where performance has begun with the consumer's prior express agreement and acknowledgment of loss of right of withdrawal.

By validating their order, French Customers expressly acknowledge:
(i) having been informed of the waiver of their right of withdrawal;
(ii) having given their express agreement to immediate performance of the service;
(iii) consequently waiving their 14-day right of withdrawal under Article L221-18 of the French Consumer Code.

10. Legal Warranties

Under UAE Federal Law No. 15 of 2020 on Consumer Protection, Customers benefit from the legal warranties applicable to services provided. In the event that the service does not conform to what was ordered, the Customer may contact Symbiose to obtain a correction or refund depending on the circumstances.

For Customers residing in France, the statutory warranty of conformity (Articles L217-4 et seq. of the French Code de la Consommation) and the warranty against latent defects (Articles 1641 et seq. of the French Civil Code) also apply. In the event of a defect of conformity, the Customer has two years from delivery to act.

11. Intellectual Property

The personalized numerology theme delivered to the Customer is the intellectual property of Symbiose until fully paid for. Upon payment, the Customer receives a personal, non-exclusive, non-transferable license to use the delivered content for strictly personal, non-commercial purposes.

The Customer is expressly prohibited from:
— reproducing, distributing, or commercially exploiting the delivered content;
— using the content for professional or commercial purposes without Symbiose's prior written authorization;
— presenting the content as their own creation.

All elements of the Website (texts, graphics, logos, images, structure) are protected by applicable intellectual property laws and remain the exclusive property of Symbiose. Unauthorized reproduction is prohibited.

12. Limitation of Liability

Symbiose's services fall exclusively within the realm of personal development. Symbiose shall not be held liable for:

• personal, professional, financial, or medical decisions made by the Customer on the basis of a numerological analysis;
• any direct or indirect damage resulting from the use or non-use of the analyses provided;
• temporary interruptions to Website access due to maintenance, technical incidents, or malicious third-party acts;
• email delivery issues related to spam filters or the Customer's email provider settings.

In any event, Symbiose's liability, if established, shall be limited to the amount actually paid by the Customer for the order in question.

13. Force Majeure

Symbiose shall not be held liable for any delay or non-performance resulting from a force majeure event, defined as any unforeseeable, irresistible event outside Symbiose's control, including: pandemics, natural disasters, armed conflicts, third-party service provider failures beyond Symbiose's control, and telecommunications or electricity network outages.

In the event of force majeure, Symbiose undertakes to inform the Customer as soon as possible and to propose an alternative solution or refund if performance of the service is definitively impossible.

14. Personal Data

The processing of personal data collected under these Terms is governed by our Privacy Policy, which forms an integral part of these Terms and is established in accordance with the UAE PDPL (Federal Decree-Law No. 45 of 2021) and, for EU residents, the GDPR (Regulation (EU) 2016/679).

15. Dispute Resolution

15.1 Customer Service — First Resort

In the event of a dispute or complaint, the Customer is encouraged to contact Symbiose first by email at contact@symbiose.club. Symbiose undertakes to handle all complaints within 14 business days.

15.2 Amicable Resolution — UAE

In the event of an unresolved dispute, Customers may refer the matter to the Department of Economic Development (DED) of the relevant emirate or to the Dubai Courts / competent UAE courts in accordance with applicable legislation.

15.3 Mediation — French Residents

In accordance with Articles L611-1 et seq. of the French Code de la Consommation, Customers residing in France may have free recourse to a consumer mediator for any dispute not resolved amicably within a reasonable time.

Customers may also access the European Online Dispute Resolution (ODR) platform made available by the European Commission at: https://ec.europa.eu/consumers/odr.

16. Applicable Law

These Terms are governed primarily by the law of the United Arab Emirates, including UAE Federal Law No. 15 of 2020 on Consumer Protection and UAE Federal Law No. 1 of 2006 on Electronic Commerce and Transactions.

For Customers residing in France, the mandatory provisions of French consumer law apply in addition to UAE law, in accordance with European Regulations Rome I and Rome II, and the consumer protection provisions of the French Code de la Consommation.

In the event of any conflict between UAE provisions and mandatory French provisions, the provisions most favorable to the consumer Customer shall apply.

17. Modifications

Symbiose reserves the right to modify these Terms at any time, in particular to comply with changes in applicable law, changes in its services, or judicial decisions. Modifications take effect upon publication on the Website.

In the event of material modifications, Symbiose undertakes to inform Customers by email or via a prominent notice on the Website, within a reasonable time before the new terms take effect. Continued use of the Website or services after notification constitutes acceptance of the new Terms.
